1. Acceptance of terms

By accessing or using the Lively website ("Site") or purchasing our products, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Site. We reserve the right to modify these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance.

2. Age requirement

You must be at least 21 years of age to purchase or use Lively products. By placing an order, you represent that you meet this age requirement. We reserve the right to cancel orders where we have reason to believe this requirement is not met.

3. Products and health disclaimer

Lively products are dietary supplements regulated under the Dietary Supplement Health and Education Act (DSHEA). They are not drugs and have not been evaluated or approved by the Food and Drug Administration.

These statements have not been evaluated by the Food and Drug Administration. Lively products are not intended to diagnose, treat, cure, or prevent any disease.

Lively products are not a substitute for medical treatment. If you have a medical condition, take prescription medications, are pregnant, or are nursing, consult your physician before use. Do not use Lively products as a reason to consume more alcohol than you otherwise would.

4. Orders, pricing, and payment

All prices are listed in USD and subject to change without notice
We reserve the right to refuse or cancel any order at our discretion
Payment is due at the time of order. We accept major credit cards and other methods displayed at checkout
You represent that you are authorized to use the payment method provided
Sales tax is collected as required by applicable law

5. Shipping and delivery

We ship to addresses in the United States. Delivery timeframes are estimates only. We are not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss and title for products passes to you upon delivery to the carrier.

6. Returns and refunds

Due to the consumable nature of our products, we accept returns only for items that arrive damaged or defective. To initiate a return, contact us at hello@livelywellness.com within 7 days of delivery with your order number and a description of the issue.

Refunds are issued to the original payment method within 10 business days of approval. We reserve the right to request photographic evidence of damage.

7. Intellectual property

All content on this Site — including text, graphics, logos, product descriptions, and code — is the property of Lively or its content suppliers and is protected by applicable intellectual property laws. Lively has filed a provisional patent application covering its proprietary co-solubilizing DHM formulation, buccal pouch delivery system, and method of use. Unauthorized use of any content or technology may violate trademark, copyright, patent, and other applicable laws.

8. User conduct

You agree not to:

Use the Site for any unlawful purpose
Attempt to gain unauthorized access to any part of the Site or its infrastructure
Transmit any harmful, offensive, or disruptive content
Use automated tools to scrape or harvest content from the Site
Misrepresent your identity or affiliation
